Merger case. ACCC's appeal against the decision of Justice Emmett was rejected. Justice Finn agreed with the reasons and orders proposed by Justice Yates in this case. - News Ltd v South Sydney District Rugby League Football Club Ltd [2000] FCA 1541 (Trial)
Justice Finn rejected South's claim that the term reducing the competition from 17 to 14 teams was exclusionary.
Justice Finn's decision was overturned by a majority of the Full Federal Court. However, on further appeal the majority of the High Court agreed with Justice Finn that the provision was not exclusionary.
