Definitions

On 6 November 2017 Part IV, Division 1A (Anti-competitive disclosure of pricing and other information) was repealed The Harper Reforms. None of the provisions in Division 1A were ever litigated.

Section 44ZZT
Goods and services to which this Division applies

 

The provision

(1) This Division applies to goods and services of the classes (however described) that are prescribed by the regulations for the purpose of this section.

(2) Without limiting subsection (1), the regulations may limit the description of a class of goods or services by reference to any matters including (for example) any one or more of the following:

(a) a kind of supplier of goods or services;

(b) a kind of industry or business in which goods or services are supplied;

(c) the circumstances in which goods or services are supplied.

(3) The regulations must prescribe a process to be gone through before regulations are made, for the purpose of subsection (1), prescribing a class of goods or services. Before the Governor General makes regulations, for the purpose of subsection (1), prescribing a class of goods or services, the Minister must be satisfied that the prescribed process has been complied with.

(4) Subsection (3) does not apply in relation to the first regulations made for the purpose of subsection (1).

Note that the Competition and Consumer Amendment Regulation 2012 (No 1) (SLI No 90 of 2012) came into operation on 6 June 2012 and inserted a new Part 4 of the Competition and Consumer Regulations 2010, which provides, in part:

For subsection 44ZZT (1) of the Act, the table sets out classes of goods or services to which Division 1A of Part IV of the Act applies.

A good or service:

(a) provided by an authorised deposit-taking institution within the meaning of the Banking Act 1959 ; and

(b) consisting, to any extent, of taking money on deposit (otherwise than as part-payment for identified goods or services)

A good or service:

(a) provided by an authorised deposit-taking institution within the meaning of the Banking Act 1959 ; and

(b) consisting, to any extent, of making advances of money
